These Terms of Use (the "Terms") govern your use of the Piano Surge mobile application and related services (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Piano Surge grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial use, subject to these Terms and the usage rules set forth in the Apple Media Services Terms and Conditions and the Google Play Terms of Service.
Piano Surge offers an optional auto-renewing subscription, PianoSurge Premium, which unlocks additional songs and features. Subscription details:
Prices are shown in the App at the time of purchase and may vary by region and currency. Local taxes may apply.
Auto-renewal. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews at the end of each billing period (monthly or yearly) unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
Managing your subscription. You can manage your subscription and turn off auto-renewal at any time in your App Store account settings after purchase. Deleting the App does not cancel your subscription.
Free trials. If a free trial is offered, any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.

If you submit a display name, score, or other content through the App, you grant Piano Surge a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute that content solely for the purpose of operating and improving the App. You represent that you have all rights necessary to grant this license.
Piano Surge reserves the right, but is not obligated, to remove any content that violates these Terms or that we, in our sole discretion, deem objectionable. We do not tolerate objectionable content or abusive users. Reports may be submitted in-app or by emailing support@pianosurge.com, and we will act on credible reports within 24 hours.
The App, including its software, design, graphics, sound effects, and original musical content, is owned by Piano Surge and is protected by copyright, trademark, and other intellectual property laws. Classical music compositions used in the App are in the public domain; specific recordings and arrangements created for the App remain the property of Piano Surge. Nothing in these Terms grants you any right, title, or interest in the App or its content, except as expressly permitted by the limited license above.
The App uses third-party services including Apple App Store, Google Play, RevenueCat (subscription management), Supabase (anonymous authentication and cloud save), and Sentry (crash reporting). Your use of those services may be subject to their own terms and privacy policies. See our Privacy Policy for more information.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Piano Surge does not warrant that the App will be uninterrupted, error-free, or free from harmful components.
To the maximum extent permitted by law, in no event shall Piano Surge, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the App. Our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid to Piano Surge in the twelve (12) months preceding the claim, or, if greater, ten US dollars ($10).
We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms. You may stop using the App at any time. Provisions of these Terms that by their nature should survive termination (including Sections 5–9 and 11) will survive.
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in California, except where prohibited by applicable consumer protection law.
